WHEREAS, in his conduct while President of the United States, George W. Bush, in violation of his constitutional oath to faithfully execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has committed abuses of power.

THEREFORE, BE IT RESOLVED that President George W. Bush has acted in a manner contrary to his trust as President and Commander in Chief, and subversive of constitutional government, to the prejudice of the cause of law and justice and to the manifest injury of the people of the United States and that he be impeached for high crimes and misdemeanors.

The ACLU is suing on behalf of journalist and human rights groups, asking the court put a halt to Congress’s legalization of Bush’s formerly secret warrantless wiretapping program. The ACLU contends (.pdf) the expanded spying power violates the Constitution’s prohibition on unreasonable searches and seizures.

Snow Falls

I am sorry to see that Tony Snow has succumbed to colon cancer, although there does seem to be a certain poetic justice there, for a Bush administration press secretary. He seemed like an affable guy. I saw him on The Daily Show, and thought he was a good sport.

I hope that he is granted a measure of peace in the media- restricted realm that lies beyond. And speaking of lies, I hope he finds the truth; a commodity in rare supply in the beltway during his time of service there, and even more scarce at Faux News.

I suppose I shouldn’t even bring it up, since it’s not nice to speak ill of the dead. Besides, listening to a Bush spokesman and saying “I didn’t hear the truth” is like leaving a whorehouse complaining, “I didn’t feel loved.”

Anyway, God is merciful, and I’m not Him.

I remember in law school, reading Learned Hand, Benjamin Cardozo, and Thurgood Marshall and thinking “Wow, them dudes is smart.” And the neat thing about smart guys like that is they make the country seem intelligent.

Going from tangential study of the Warren Court to the Roberts Court has been like watching a strong old oak gradually succumb to fungi and moths, and wither and die. And it makes me angry and I wish I could remember why. I wish Warren Burger was still alive; he would know.
